etherFAX takes the security of customer information seriously. It is our policy to ensure that documents or content communicated through the provided Services remain confidential while in etherFAX’s custodial care. etherFAX accomplishes this by adopting and implementing policies that meet or exceed compliance with recognized security and privacy standards such as PCI DSS, HITRUST, GDPR, CCPA, and other industry best security practices. These practices include the use of encryption, along with strong security defense systems to prevent malicious eavesdropping of sensitive information and other nefarious attacks on its overall operation. Customers can be confident that etherFAX follows these security policies, practices, and procedures due to the fact that etherFAX continually submits its operations to auditing by industry recognized/trusted third party verification organizations.
At the core of etherFAX’s security is to maintain a zero data retention policy for all customer document content information communicated through the use of the Service. Content received through the Service or sent by you through the Service is only maintained for the time necessary to complete the transfer of information between you and the at least one other party. Once the transfer operation has completed (success or failure), the document content information is purged from etherFAX’s systems. Therefore, you are responsible for maintaining the document content information for any residual purpose. Please note that depending on the origin or the specified destination of a document transfer request, the communication of a document’s content information may be subject to inherent limitations of the interconnect technology or the peer system’s capabilities.
In the course of managing our website and our web-services, we may use cookies and track information about visitors and users. This may include but not limited to tracking of the URL that visitors come from, the URL that visitors go to next, visitor browser versions, and visitor IP addresses. This information is used only for the purposes of assisting etherFAX in understanding the use of and increasing the functionality of routine operation of our website and web services. This information is never sold to third parties by etherFAX.
For the avoidance of doubt, etherFAX does not create or generate document content on your behalf, nor does it monitor the contents of incoming and outgoing documents or distribution lists. Any software that is made available to download from our website or web-service (“Software”) is the copyrighted work of etherFAX and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”). Any end user shall not install or use any Software that is accompanied by or includes a License Agreement, unless the end user first agrees to the License Agreement terms.
The Software is made available for download solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent provided by law.

By way of example, and not as a limitation, you agree that when using the Communication Services, you will (a) comply with FCC Regulations regarding unsolicited fax transmissions (b) not use the Service for illegal purposes, including but not limited to distribution of unsolicited facsimile advertisements; (c) not use the Service to infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; and (d) not transmit through the Service any unlawful, harassing, libelous, threatening, vulgar, obscene or otherwise objectionable material. The Service may use filters and other technologies and procedures to terminate unsolicited fax advertisements without delivering them.
etherFAX reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. etherFAX reserves the right at all times to disclose any information as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to limit your use of the Services in its sole discretion.
etherFAX does not control or endorse the content, messages or information found in any Communication Services and, therefore, etherFAX specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Services.
